Oscar Pistorius will not be acquitted, that isn't his team's strategy anyway.

Oscar Pistorius shot at a door either knowing or having the duty to know that someone might be hit and killed by his bullets. Whether it is a robber or Reeva behind the door is irrelevant: the Error in Objecto rule, where someone intends to murder A, but accidentally murders B, still results in a murder conviction. Furthermore, aberratio ictus or missing blow theory cannot negate guilt if the wrong target is hit with intention to murder another target: but this sister of Error in Objecto, would not apply here, as it is not a case of the wrong target being hit due to bad aim. Likewise, private defence, what Americans call 'self defense', in South African law rests not on perceptions of danger but on objectively viewed imminent danger to the person's self. Whatever Oscar thought: Reeva was no threat to him, it thus cannot be said to be private defence. Such is the view of long established and long enforced case law. The law can change, but that is what the law is as it stands.

Before we get onto the other factors, we must remember that in South African law: if you can foresee that it is a real possibility that something (an unlawful death) will result from an action, and nonetheless/recklessly proceed with behaviour risking that possibility (dolus eventualis), it is murder not culpable homicide. If the facts show you did not foresee that possibility but a reasonable person would have, then your actions are culpable homicide. A further aspect lies in that those heart strung jury arguments in the west do not stop a murder charge: they emerge in mitigation, even complete mitigation of all jail. It is not in dispute that Oscar shot and killed Reeva Steenkamp. It is not disputed that she was no objective threat to Oscar Pistorius. The only way he could be completely acquitted is based on temporary insanity in the form of 'provocation'.

So what are Oscar's team aiming at?

Either culpable homicide (what Americans call manslaughter), and maybe a year or three in jail if he is lucky.

Or Putative Private Defence (my bet would be on this).

Or provocation (from the French word for cause).

Culpable homicide:

- The law requires a warning shot prior shooting.
- A reasonable person would not have shot through a door without checking if it was Reeva.
- Shorter sentence, not murder but a competent verdict of murder.

Putative Private Defence:

- An established part of our law: applicable when a person believes they are acting in private defence but are not.
- This goes both for proportion of response and for factors which appeared true to the accused, but were objectively false.
- The accused is convicted of murder, but gets mitigated sentencing and possibly even no jail time.

Provocation:
- One must give medical evidence that whatever caused the actions was based on uncontrollable sane automation. This is to be done via medical evidence: since the Eadie case we use medical evidence to prove temporary insanity. A neuropsychologist might be the appropriate expert witness.
- Classic Provocation is no longer a part of our law since the Eadie murder conviction, as the Supreme Court of Appeal set forth at that time:

'[57] I agree with Ronald Louw that there is no distinction between sane automatism and non-pathological incapacity due to emotional stress and provocation. Decisions of this Court make that clear. I am, however, not persuaded that the second leg of the test expounded in Laubscher’s case should fall away. It appears logical that when it has been shown that an accused has the ability to appreciate the difference between right and wrong, in order to escape liability, he would have to successfully raise involuntariness as a defence. However, the result is the same if an accused's verified defence is that his psyche had disintegrated to such an extent that he was unable to exercise control over his movements and that he acted as an automaton - his acts would then have been unconscious and involuntary. In the present contest, the two are flip sides of the same coin. The judgments of this Court referred to earlier, as the highlighted parts of relevant dicta show, see it as such.

'[59] Whilst it may be difficult to visualise a situation where one retains the ability to distinguish between right and wrong yet lose the ability to control one’s actions it appears notionally possible.

'[60] The view espoused by Snyman and others, and reflected in some of the decisions of our courts, that the defence of non-pathological criminal incapacity is distinct from a defence of automatism, followed by an explanation that the former defence is based on a loss of control, due to an inability to restrain oneself, or an inability to resist temptation, or an inability to resist one’s emotions, does violence to the fundamentals of any self-respecting system of law. This approach suggests that someone who gives in to temptation may be excused from criminal liability, because he may have been so overcome by the temptation that he lost self-control - a variation on the theme: “the devil made me do it”. It is for this reason that it was suggested earlier that the use by Joubert JA in Laubscher's case, supra, of the word "weerstandskrag" was unfortunate. So too was the use of the word "drang" in Campher's case at 956 B, referred to in paragraph [32] of this judgment. These words suggest a resistance to urges or temptation. No self-respecting system of law can excuse persons from criminal liability on the basis that they succumbed to temptation. Against the fundamental principles restated by JM Burchell (quoted in paragraph [58] of this judgment) it is with respect, absurd to postulate that succumbing to temptation may excuse one from criminal liability. One has free choice to succumb to or resist temptation. If one succumbs one must face the responsibility for the consequences.

'[61] The time has come to face up to the fact that in some instances our courts, in dealing with accused persons with whom they have sympathy, either because of the circumstances in which an offence has been committed, or because the deceased or victim of a violent attack was a particularly vile human being, have resorted to reasoning that is not consistent with the approach of the decisions of this Court. Mitigating factors should rightly be taken into account during sentencing. When an accused acts in an aggressive goal-directed and focused manner, spurred on by anger or some other emotion, whilst still able to appreciate the difference between right and wrong and while still able to direct and control his actions, it stretches credulity when he then claims, after assaulting or killing someone, that at some stage during the directed and planned manouevre he lost his ability to control his actions. Reduced to its essence it amounts to this: the accused is claiming that his uncontrolled act just happens to coincide with the demise of the person who prior to that act was the object of his anger, jealousy or hatred. As demonstrated courts have accepted such version of events from accused persons.'

(S v Eadie (196/2001) [2002] ZASCA 24 (27 March 2002))

So, if Oscar's team can prove temporary insanity due to extreme fear: then he is in that scenario, acquitted and off the hook: for the murder itself: the problem is proving medical sane automation/ temporary insantiy. However that is not his likely intent. His likely intent is mitigation. Or change of law.

British/Canadian International incident: the complexities of the Canadian tranny PRISONER'S DILEMMA.

THE COMPLEXITIES OF THE CANADIAN TRANNY PRISONER'S DILEMMA.

A British gentleman by the name of Mr Avery Edison, was caught entering Canada illegally at Pearson International Airport. He had had an expired student visa listing him as male, which had previously allowed him to be within Canadian borders. His girlfriend of two years, was awaiting his visit, according to the Toronto Star. Avery is set for deportation, and will not be allowed to see his girlfriend, according to authorities and his lawyer. LifeSiteNews, however has a very extensive rendering of the events up to this point.

Avery Edison tweeted his girlfriend and common law partner, Canadian, Miss Romy Sugden, however that there was some confusion about his gender. He had taken to wearing a dress since his last visit to Canada, and his British passport had been ammended to list him as female, although he still had male parts and a girlfriend. Maplehurst Correctional Complex, is where he was being sent, a men's correctional facility.

Avery Edison, was then to be examined by a nurse to determine his gender.

As Avery Edison still had a penis, they determined he was male, his girlfriend Romy Sugden stated to media. In accordance with Ontario law and the Ontario Human Rights Commission policy document, Avery Edison would be referred to as a male until such time as he has cosmetic surgery altering his private parts to a female appearance. The prison officials for some reason changed their path in this case, not going by birth gender as the policy is, but transferring Avery Edison to Vanier Centre for Women, while he was to await his immigration hearing. He was to be kept separate from the general prison population.

The transfer itself, from a male correctional facility, and the keeping of the prisoner separate both could be in the interests of preventing the public relations nightmare of Avery being harmed by other prisoners. Another aspect is that another man identifying as female, was placed in a women's correctional facility and in December was transferred after he engaged in sex with female prisoners, this other gender bar bending event occurring in Scotland in the United Kingdom.

Ontario's Human Rights Commission's chief official recently wrote to a local newspaper. The chief official was much aggrieved by a something a woman had written within the newspaper fold, in which the woman complained that a naked erect man was sexually harassing women in a woman's restroom at a public space, which restroom he remained in under the guise that he self identified as female. The human rights chief, was infuriated with the woman for objecting to the man's presence, and made known that the woman must be deeply prejudiced to write about the sexual harassment. The human rights chief took the side of the man in a hotly worded letter to the press. The woman who did not like being sexually harassed by a naked, erect man, was much maligned by the human rights chief, who gladly took the side of the man in the event.

Western Journalist writes appreciation for 'wonderful', 'marvellous' 'SOTH African' alcohol advert...

ABOVE: a retro Bells Advert: not the one being raved about by the American journalist, which is included as a video below the story and screenshot.

Patrick Archbold is an established blogger and a journalist for the National Catholic Register, an American publication. His blog Creative Minority Report for years defined the word 'pithy' for readers... in case he thought to use it. He is known for his moral arguments, his political beliefs and his humour. Unfortunately... Yesterday some of his humour was a tad accidental, as he misspelt 'South Africa' in showing appreciation for an advertisement for Bells Scottish Whisky. The blog he got to know of the advertisement from noted it created meaning in a manner 'respecting' the soon to be alcoholic audience... unlike American Superbowl commercial advertisements...

One assumes this bids well for South African advertising agents... none the less, our country still seems a tad hard to spell after watching such an advert.

Notice the blog title like that on Twitter... spells the Republic of South Africa as 'Soth Africa'.

True to form and established humour, Patrick took our criticism with a shot of good humour, and informed us the article had been corrected. Fortunately, he only jokingly 'condemned' us to 'purgatory' for pointing out he misspelt the name of our beloved country after his appreciating an advert for Bells Scottish Whiskey.

Someone should give the man a bells;)!~ I assume that sentence makes all the difference... to the good advert starved American football audience.

To See the now corrected post by good humoured Mr Patrick Archbold (who really is quite a fun lad to read)...

http://www.creativeminorityreport.com/2014/02/wonderful-ad-from-soth-africa.html

P.s. The South African government is looking to ban advertisements such as the ones shown above, they believe such portrayals of alcohol promote alcoholism and must, like the now banned cigarette advertisements: disappear like the memories of a life drinking whiskey.

Putin seeks endangered Persian Leopard...

Russian President Vladimir Putin, may be known for his photo shoots with every sort of manly scenario, but when a Persian Leopard needed a cuddle, he was more than accommodating. The Russian President visited Sochi National Park amid the Olympics, auspiciously to promote awareness of the endangered Persian Leopard population.

The Russian Presidency were sure to post a picture on Twitter, as were Russia Today (who's photograph our own editor, Marc Aupiais linked to on his Twitter [seen above]).

French Media accuse man of animal abuse against a 'car'; 17 mag calls Selena Gomez a whore...

A caged animal must run? A caged car is a car that doesn't go fast enough? French radio station Radio France International say in their Twitter card preview that a man locked a motorvehicle into a cage and threw chemicals at it and thus has been convicted of animal abuse. They meant he did so to a poor little cat, but unfortunately that isn't what a reasonable read of what they wrote relays.

Selena Gomez is having a bad week, with all the accusations being made by Radar online alleged anonymous sources. To make things worse 17 Magazine gave Selena the cover, and in their Twitter preview called her a whore... and Selena Gomez linked to the article.

UK Telegraph caught red handed using false images in attempt to discredit Sochi olympics in Russia...

Above: Actual image by a Canadian journalist: our investigation showed this to be an original photo, unlike the hoaxes put forward by the UK Daily Telegraph and other media below.

Certainly some stories of Sochi may be true, but many are hoaxes or cruel sattire seemingly purposely put forward as though fact by biased Western journalists

Maybe accusations of painting grass green, and menu mistranslations are true, and maybe the Western bias is working at full speed ahead...

Here are some questionable items by journalists shown as though fact by the UK Telegraph, who wrote an article on journalists criticising Sochi:

'Pro-Lifer' Steven Ertelt, an online spammer, unethical, and an internet troll!

Article continues below audio summary:

"Babies are dying and you're upset over a few tweets." - a more polite part from Steven Ertelt's wordy response to this article, our exclusive expose, which you can read below.

One account which continuously follows and unfollows my Twitter, and insistently tweets defamation about his competitors in 'pro-lifing' is Steven Ertelt.

Notice any commonalities (p.s. the tweet below to SACNS is quite upsetting and tweeted to many, the one later and above, shows he doesn't even know who he is haranguing when he does this)

His favourite enemy is reliable news service LifeSiteNews. Tweet an article from them, and he is sure to sweep upon you like a seagull upon the pope's peace doves.

His most recent trolling: the death of a pregnant woman:

After we made note of Steven trolling, he deleted the I don't know who you are Tweet to our editor.

To answer the question likely burning, yes, I know Steve considers his website to be just that, and not a blog: but trolling is quite a blogger behaviour, not something I expect from a news editor. After I noted who I am, he none the less chose not to continue his trolling this time, and decided not to dispute the nature of his activities or his website. Instead, he determined to troll someone else...

Despite us blocking his account, Steve replied when he saw our article:

To our knowledge we only wrote this article, I love his use of the word blog which we used above also, read on, to find out about 'blog posts', seemingly in plural, and more yet more, of Steve's response.

Steve then mentions a state employee taking a position on the nationally noted case, as his reason for tweeting many people about his objection to LifeSiteNews. The Attorney General, he argues is vindicated because a state employee made a stance, and thus so is his mass tweeting of anyone who tweets an article by his competitor LSN.

Definitely the case?:

Despite Steve quite a number of times now Tweeting me when I share their articles, and LifeSiteNews Canadian editor lamenting to me that Steve consistently did so:

New French 75% Tax... a disincentive to employees, or a strengthening of state power? Or both?

It was about a year ago... Francois Hollande's socialists were taken to court. The French Constitutional Council angrily struck down a law that would tax individuals 75% of their income above a certain amount. Hollande's Marxist core took a brief step back and puzzled on how to attack the wealthy. Not the wealthy independently this time, but employees. If a company paid their employees above a certain amount, Hollande would have the company taxed the 75%. His ingenious scheme has no parallel other than the Collins v Minister of Interior 1957 (1) SA 552 (A), which heralded apartheid by a similar such moving of semantics and maintenance of substance. The French Constitutional Council has validated this slightly different move that largely keeps substance.

The question must be asked then: won't such a move disincentivise French employees from working all the more to achieve a higher salary beyond a certain point? Will not the skills exodus from France increase by this taxing of those who work hard enough to earn that amount? How will something which contributes such a small amount to Gross Domestic Product but causes those wealthy enough and skilled enough to earn such an amount to leave France really benefit the people?

The simple answer is it won't by in large benefit the French people, but there are many examples in history of grand utilization to rely on.

When Apartheid came to dominate South African politics, Catholic schools lost their government funding. As a powerful force against disintegration, it was inevitable the church would be targeted. Communist China had university professors and the wealthy targeted and humiliated or dealt with in her early days. Stalinism took a similar approach.

The ancient Spartans ruled over a slave population. If a slave became too good at harvesting or too skilled, the Spartans would end the life of that slave with a knife in the night. It was an effective mechanism of control. A government or slave master who takes on the hardest working, most effective people, destroys the desire to be exceptional, and along with it most grand cultures in which competition to authoritarianism might covertly fester in an intelligent, or clandestine manner.

Zheng who would build the great wall of China and the Terracotta army, moved all the aristocratic families away from their fiefdoms into his capital in his Qin dynasty. It would fare him well as he taxed the Chinese to near extinction before his dynasty disappeared.

What better way to enforce socialism and the power of government than to disincentivise those who work the hardest for their companies, and cause them to either be taken down significantly, or move countries as many French entrepreneurial future leaders have?

People who make a lot of money are admired by others, listened to by others, unless they are demonised as many modern authoritarian regimes attempt to.

So why did the Spartans murder the best of their slaves? Mediocre workers are better than free workers to a slave-master. A mediocre worker does not challenge the slave-master. Even if one does, he is a mediocre worker, what does he know?

But, a successful hard working individual, a super-ultra-talent who warrants a massive salary... if they challenge the government? Well, the socialists demonise such a person, and when that is not enough they punish them for being exceptional, for not being the mediocre same that socialism requires of her adherents. When that is not enough, the socialist regime tries to take away the exceptional in the person by stealing their fruits of success. Driven by envy, others might relish in this taking down of the great. Others might believe the lies that those who work hard to etch out a future are the devil himself. The people on social welfare might be compared to angels... as they are in the modern world: the chief concern of the state.

Perhaps if instead of punishing ingenuity and expertise, governments such as in France were to incentivise such, the poor might be drawn out of poverty.

Unfortunately marxism creates the concept of inequality... that if the rich get richer it is a bad evil thing. Perhaps if rather than fighting inequality and making it in the best interest of exceptional individuals not to play the game, governments were to fight the real enemy of poverty with the aid of the exceptional... well then... perhaps there would be no place for Hollande's socialists to get votes...

Indeed, Hollande, France's least popular president has found a way to romanticise poverty... all as his economic incompetence insures all the more that France's poverty lines excel in expansion. Meanwhile those employees who are targeted for fulfilling expert work, shall likely find somewhere else to grace with the fruits of their labour, somewhere that values hard work, and those who conduct it and then spend their money from it in such a place.

E-tolls violate the right not to be subjected to slavery...

[Written form article continues below embedded audio summary.]

Fast credit: Shocking? Or everyday business?

'Wonga offers £400 loan to 13-year-old boy which would take 98 years to pay back'

Food for thought: A headline in the British newspaper Metro on 23/11/2013

A contentious thing:

The newly arrived e-tolling system, which has been imposed upon the Gauteng freeways has been challenged on many grounds. Some say that it violates the right to free movement. Others questioned to what extent the government is permitted to privatise public resources. There certainly is the public international law ideal that the state holds resources in trust for the population: that it is say as a trustee rather than an owner. As a trustee the state therefore must act in the best interests of the population and not in the best interests only of a small minority of special interests. This concept is why tender fraud is such a big issue. None of these arguments are one which I am going to be making today.

A system of credit and debt:

The argument I am here today to make also is not based on reckless credit in accordance with the statutes of South Africa. However, the purpose for the statutes illuminates a constitutional right, and what is more a human right. There is a long history of persons becoming indebted beyond their means to escape their debts. This was in fact one of the means by which slaves were gained by large landholders in certain areas of the world. A person was made to become so legally indebted to another that they are forced to work for the remainder of their life always in debt to the other individual and always forced to work for that individual. In contract law classes, South African law students study a case where a doctor agreed that a vast majority of his salary would go to paying off a debt. The court found that the contract was against public policy and therefore unenforceable as it turned the doctor into essentially what the court called a slave. The e-tolling system has according to SANRAL: been seemingly exempted from the National Credit Act provisions which prevent the issuing of reckless credit.

In order to issue credit, a credit provider must ensure that the person to whom they issue credit, is capable of paying back the credit in their circumstances. The National Credit Act also allows for debt counselling for debtors who cannot possibly afford to pay back their debt. SANRAL seems insistent that this does not apply to e-tolling.

E-tolling is essentially a system of credit. Whenever an individual rides on an e-tolled road, that individual is essentially taking out a loan from SANRAL. It is like swiping a credit card. However, if a person is unable to pay off their credit card the credit card is cancelled. A person who takes out credit from SANRAL can essentially take out unlimited credit whether or not they are able to pay off their debt. A person who earns 1000 Rands a month: could accrue a debt of 10 million Rand. This person would not be afforded debt counselling according to SANRAL. This person would simply have to pay off their debt. It is expensive to file for insolvency, and some return needs to be shown for creditors. Stating that insolvency is a way out of such a debt, also is not stating an absolute solution in such a case. Could such an applicant for insolvency show even one cent to the Rand return for creditors? Would it even be possible for them to file for insolvency? Furthermore, causing a person to become insolvent deeply changes their status, their ability to do business, and their means and resources on which to live.

Micro-lending and Marikana Tragedy:

An aspect of Marikana and the tragic shooting which took place there which is not often brought up is that of micro-lending. Many of the miners who went on strike had taken out small loans. Their salaries were garnished, in order to allow the creditors to reclaim their money. The miners thus could not afford to live and support their families. The unrest was almost inevitable as a result of credit having been granted when it ought not to have been. The absolute desperation of the miners who charged the police at Marikana: should surely hint at the predicament of the indebted miners. Their determination to strike in desperation to bring something home to live on and to support their families: surely shows the effects upon the economy of such strange granting of credit where it ought not to have been granted.

Who are the Debtors?:

Many South Africans are illiterate. Many South Africans do not have basic mathematical education or literacy. Many South Africans are deeply poor. Many South Africans barely get by. These sort of things need to be taken into account by ordinary businesses doing business. Extending a person an unlimited line of credit and expecting them to pay it back without any chance of doing so: no doubt strikes one as immoral. Immorality is not enough. It has to be legally reprehensible. Thus one has to ask in accordance with the Bill of Rights: is the extension of unlimited credit with no cut-off points and no contingencies unconstitutional. I would say that it could well violate the right not to be enslaved. I would say that it could well violate the right to life in as much as it affects a person’s ability to earn a livelihood. I would say that such unfettered granting of unlimited credit could well violate the right to dignity of the human person.

Perhaps I am wrong. However I do believe there is a strong argument that the granting of unlimited and unfettered credit to persons regardless of their creditworthiness or their circumstances and ability to pay back that credit: violates the rights of the debtors.

Man's best friend/ canine compass? : Dogs tend to poop facing North or South, extensive study by scientists finds.

Depending on whether magnetic conditions were calm or disrupted, dogs tend to align their bodies with the magnetic poles in order to excrete, a study suggests.

'Researchers from Czech University and the University of Duisburg-Essen in Germany observed 70 dogs from 37 different breeds over the course of a two-year period.

'They found that dogs preferred to excrete when their body was aligned along the north-south axis under "calm Earth's magnetic field (MF) conditions." '

(Times of India 'Dogs poop in line with the Earth's magnetic field' by PTI at Jan 3, 2014, 04.56 PM IST)

The scientists' breakthrough may be difficult to replicate without high technology however, as calm Magnetic Field conditions only occur one fifth of the time, and dogs only do the doozey in line with the poles when the magnetic field is calm. That means your dog might not be a replacement for your compass after all.

Man murdered at 00:00 on 1 January 2014

Rob Meek deceased of subsequently fatal gunfire... to his reproductive area, seconds after the clock struck 12, and 2014 commenced.

There are many ways to celebrate the passing of a new year... causing another person to pass away is one of the more unusual methodologies.

A man by the name of Rob Meek, was photographed celebrating the end of 2013, at 00:00 at 1 January 2014. Little did he know the end of 2013 would warrant his end.

Three men with faces obscured by balaclavas approached the Wild Coast Beach House Rob Meek was celebrating in. One shot him, all three disappeared, according to the Cape Times. The newspaper puts it down to a robbery gone wrong... but the version of events presented is suspicious, so far as the events did not fit an ordinary robbery. Were there really three armed men? This seems likely, from the witness' accounting of the terrible event she and the others encountered. Did he die in another manner? Was it a robbery or was it a hit? Rob Meek apparently eeked out his existence as an urban designer, and was a sailor, well known we are told. Yet, the events seem more appropriate to a hit than a robbery.

His family rushed him away to get help, to no avail. The end of 2013 ushered in the end of Rob Meek, with the passing of another year, Rob Meek passed away. I had never heard of him prior his death, but he certainly died in an deeply perplexing manner. The Cape Times give an account:

'“We moved out on to the deck overlooking the sea. The flash went off. We popped some champagne. We all cheered.

'“You can see in the photo my husband had turned around. He’d already seen the three guys,” Meek said.

'She said three men wearing balaclavas approached them. She said they looked as if they were holding pieces of wood, as residents had done earlier while offering to make bonfires. “My husband said: ‘They’ve got guns,’” Meek said.

'Meek, who had seen three guns, did not recall hearing the three men ask for anything.

'She lay flat on the deck.

'“They looked nervous. I heard a shot. I just saw my husband... There was no provocation.” After the shot went off, wounding Rob in the groin area, Meek said, the gunmen ran away. They had not stolen anything.

'She, her family and friends managed to fashion a tourniquet to try to staunch the blood flowing from Rob’s wound, and they carried him up a steep hill from the house to a vehicle.

'“We got him into the back seat. My daughters sat and spoke to him. I was driving.”

'Meek said at a nearby “TB mission hospital”, two doctors tried to save Rob. Her daughters also tried to resuscitate him and “kept pumping him with oxygen”'

As Colorado begins a journey into weed...

Call it what you will: Dagga... Weed.. Marijuana.. Cannabis...

It has increasingly become the in thing in the U.S.A.

With legalisation there and elsewhere, and its popularity, you may be wondering why it is governments ban narcotics. You may think perhaps it is to protect drug addicts. That might be what your resident government says. When we did forensic medicine in law school, a different story was told.

Most crime could be eliminated if narcotics and drugs were not abused. Where drug use increases, so does the crime rate. This is why drugs were initially banned, and the real reason to keep drugs banned. Yes, cannabis also is known to cause schizophrenia among other side effects, but if we are honest... it is the links between intoxicants and unnatural deaths, both of addicts and of those they might commit harm against which causes prohibition of substances.

So... good luck to Colorado... science shows your crime rate is about to sky-rocket just a little bit more.

But it is legal now, you say? So? Alcohol is legal... and as a result many more crimes are committed and many more people die of foolish Dutch courage. Alcohol is a part of life, narcotics don't have to be.

University of Witwatersrand publishes Nelson Mandela Obituary...

Article by Marc Aupiais

The University took to social networking to apologise profusely, for what they called a technical error, blaming Google search for picking up an unpublished piece. It had accidentally pre-empted the death of former convict of Robbin Island maximum security prison, and one time President Nelson Mandela.

'

The University of the Witwatersrand, Johannesburg extends its sincerest apologies to the family members, friends, fellow South Africans and global citizens for an obituary related to the death of former president Nelson Mandela that was not published or issued by the University.

The University had prepared a statement which was hidden on its systems. However, a technical error made this available via the search function on Google. At no stage did the University issue this statement or publish it on its website.

The University regrets the mishap and will take all the necessary steps to get to the root of the technical error and to ensure that the responsible departments are held accountable for this incident.
'

Here, from ENCA: is their cause for apologising:

'In the message dated 31 July 2013, the university “expresses its deepest condolences to the family and friends of former president Nelson Rolihlahla Mandela, his comrades, to those who knew him well, to our fellow South Africans, to our staff, students and alumni, and to every global citizen that he touched through his thoughts, words, character, actions, presence and being.”
It goes on to say, “He was of us, but not ours as he belonged to citizens around the world. Not only has he transformed our lives, but also those of generations to come. Mandela’s unrivalled standing as a leader has been won by indomitable courage in the service of principle and in his striving for freedom, justice, democracy and equality. For liberty in this country, Mandela has never flinched to sacrifice his own; nor himself.”
It adds, “Madiba, the father of our nation, was Wits University’s most illustrious student and alumnus. He blessed us with his presence over the years as a student, a politician, an activist, as an Honorary graduate, as a President, a guest and as a friend of the University.
"We were blessed to have him in our midst and we – all Witsies, all South Africans, all Africans and indeed all of humanity must continue to uphold the ideals for which he lived, and those for which he was prepared to die.”
The university also mentioned an Honorary Doctorate it bestowed on the elderly former president in 1991 “for his ‘commitment to justice [which] drew him out of his profession and into national leadership,” adding “Mandela’s life has been an inspiration, here and throughout the world, to all who are oppressed and deprived, and to all who care about oppression and deprivation. He will remain an inspiration to Wits University, and for future generations of humanity.”'

Man arrested by police, after threatening death plunge off Eiffel Tower

Article by Marc Aupiais

The Eiffel tower in Paris, France was evacuated at 13h00/1 PM, as a man threatened to commit suicide by jumping from the structure. The Paris emergency services went into their top gear, in an attempt to resolve the nightmare, but ended up having to arrest the unstable polish national.

A police source told Le Huffington Post, that the man, who claimed to be a polish national was successfully apprehended at 15h00 / 3 PM. The jumper was described as 'psychologically unstable' by a spokesman for the Paris fire department, and had planned to climb from the second floor where he had been, to the third floor, demanding cameras record his plunge.

Police, Le Huffington Post, adds, had set up a security perimeter, and a score of fire-fighters, aided by two fire trucks and multiple lighter vehicles, attempted to resolve the cliff hanger of a situation. Ticket sales were temporarily halted. Le Huffington Post reports that prior the arrest: medical personnel from the Paris Fire Department, had attempted to reason with the suicidal man. Finally, police, at 3 PM took decisive action, before the depressive man could do likewise.

Conservative Conservation

Article view by Marc Aupiais

In the wild, how one would survive best: is to use what one needs to use only when it is necessary.

To destroy something you need for something other perhaps in the future: should only be done if it is the only way to achieve a needed end. To take the energy to carry an important thing is necessary, but sometimes it is needed to travel as light as possible, if the testimony of the Bushmen is a true one.

In the environment, we need to move away from activist language and into reality. The fact that almost everything the Green movement has claimed is a lie: from an ice age in Europe, to the end of the Himalayas Ice: makes their claims that science is to be a basis ridiculous. Their 'science' is nothing but lies.

That said, true science and wise use of resources: choosing simpler ways to do things etc could save us all.

Most of saving the environment without costing lives and economies is by simple solutions. Often lost.

Insulation, green roof-tops, roof and house paint, solar powered water, heat pumps, not so full kettles, etc.

A jersey or jacket instead of air-conditioning. A blanket over the window instead of both.

Sound advice: the gospel of using natural solutions: this is how we can save our planet. Efficiency! Professionalism, curatorship of our lives.

The use of a motor-vehicle powerful enough for our needs. Our everyday needs.

The world was not always reliant on much coal, oil, and electricity. Simpler, older solutions can be the answer.

A global effort at combating climate changes, can only happen on the basis of truth. I truly pray with all my heart that proven frauds such as the UN panel on climate change and Al Gore, are openly known for their lies. That those who hijacked environmentalism for their own selfish agendas are stopped.

But I do more than that: I tell the truth about the environment, because that is the only way to combat climate changes: sound solutions to Eco-problems: in a way sustainable in a real world economy.

Myths, and all out lies have no strength! But truth and openness to lower and simpler solutions acceptable to the existing marketplace will save us from any partly possible climate changes being an issue!

Finally Kindle on the Blackberry Tablet: the so-called Playbook (nothing dodgy meant by that)

Article note by Marc Aupiais

It may seem just a plaything, though some consider it their playmate, the Blackberry Playbook however came minus one functionality my every other device had: a proprietary Kindle Book reading application.

Cloud Reader, for Ipad just wouldn't display or open books. Today, when I tried for the umpteenth time, I changed the orientation and true to form, it seems that the system was tricked. It has even opened a novel, although perhaps the entire system was updated.

Kindle for Blackberry Playbook with a work around, at least cloud reader, which given I always have internet over tethering or wi-fi: is good enough for now.

Not Carbon Based Global Warming After All- Nasa Satellite DATA Study

Article by Marc Aupiais

Forbes reports (And please note, additional research by our service shows they chose to publish it under their online blogs section)
New NASA Data Blow Gaping Hole In Global Warming Alarmism 27 / 28 July 2011
James Taylor
http://news.yahoo.com/nasa-data-blow-gaping-hold-global-warming-alarmism-192334971.html

The study, by the University of Alabama, based on Satellite Data claims that "Global Warming" caused by carbon trapping heat in the atmosphere is so minimal as to be negligible. The research, if noted by Carbon model proponents is sure to be hotly disputed.

As I reported recently, the Daily Mail, reported on a press release by the University of East Anglia, saying that most of the temperature DATA used to correlate with carbon levels in the polar ice, on which global warming claims are based, was destroyed by scientists in the 1980s, British media also reported on great inaccuracies in climate change claims involving the Himalayas, and other regions. The Daily Mail, and other media also recently reported that Earth is set to enter a mini-ice age, due to a temporary lack of Sun Spots (a phenomena discovered by Galileo centuries ago, which then lead to a 2 degrees centigrade reduction in temperatures). Media claiming climate science was in peril include: Daily Mail, the Times and Sunday Times, and the Telegraph in Britain, the first and last still claiming global warming as real.

Ian McEwan says Americans are 'profoundly bored' by climate change
The Telegraph; By Anita Singh, Showbusiness Editor8:00AM BST 17 Jul 2010
http://www.telegraph.co.uk/earth/environment/climatechange/7895747/Ian-McEwan-says-Americans-are-profoundly-bored-by-climate-change.html

The most recent discovery, that the computer models were wrong, would not surprise the  columnists of these papers, which have for years cited the completely inaccurate short and medium term climate forecasts of the British weather servide, since climate change variables were introduced.

The alternate view of climate change is that it is constant and consistent, and more recently caused by soil changes, urbanization and astronomical phenomena such as sun spots etc.

University of Alabama, USA has released the following statement to the Press, July 26th 2011, according to a source cited by the Yahoo News article (Forbes hosted on Yahoo)

"Climate models get energy balance wrong, make too hot forecasts of global warming

HUNTSVILLE, Ala. (July 26, 2011) — Data from NASA’s Terra satellite shows that when the climate warms, Earth’s atmosphere is apparently more efficient at releasing energy to space than models used to forecast climate change have been programmed to “believe.”

The result is climate forecasts that are warming substantially faster than the atmosphere, says Dr. Roy Spencer, a principal research scientist in the Earth System Science Center at The University of Alabama in Huntsville.

The previously unexplained differences between model-based forecasts of rapid global warming and meteorological data showing a slower rate of warming have been the source of often contentious debate and controversy for more than two decades.

In research published this week in the journal “Remote Sensing” http://www.mdpi.com/2072-4292/3/8/1603/pdf, Spencer and UA Huntsville’s Dr. Danny Braswell compared what a half dozen climate models say the atmosphere should do to satellite data showing what the atmosphere actually did during the 18 months before and after warming events between 2000 and 2011.

“The satellite observations suggest there is much more energy lost to space during and after warming than the climate models show,” Spencer said. “There is a huge discrepancy between the data and the forecasts that is especially big over the oceans.”

Not only does the atmosphere release more energy than previously thought, it starts releasing it earlier in a warming cycle. The models forecast that the climate should continue to absorb solar energy until a warming event peaks. Instead, the satellite data shows the climate system starting to shed energy more than three months before the typical warming event reaches its peak.

“At the peak, satellites show energy being lost while climate models show energy still being gained,” Spencer said.

This is the first time scientists have looked at radiative balances during the months before and after these transient temperature peaks.

Applied to long-term climate change, the research might indicate that the climate is less sensitive to warming due to increased carbon dioxide concentrations in the atmosphere than climate modelers have theorized. A major underpinning of global warming theory is that the slight warming caused by enhanced greenhouse gases should change cloud cover in ways that cause additional warming, which would be a positive feedback cycle.

Instead, the natural ebb and flow of clouds, solar radiation, heat rising from the oceans and a myriad of other factors added to the different time lags in which they impact the atmosphere might make it impossible to isolate or accurately identify which piece of Earth’s changing climate is feedback from manmade greenhouse gases.

“There are simply too many variables to reliably gauge the right number for that,” Spencer said. “The main finding from this research is that there is no solution to the problem of measuring atmospheric feedback, due mostly to our inability to distinguish between radiative forcing and radiative feedback in our observations.”

For this experiment, the UA Huntsville team used surface temperature data gathered by the Hadley Climate Research Unit in Great Britain. The radiant energy data was collected by the Clouds and Earth’s Radiant Energy System (CERES) instruments aboard NASA’s Terra satellite.

The six climate models were chosen from those used by the U.N.’s Intergovernmental Panel on Climate Change. The UA Huntsville team used the three models programmed using the greatest sensitivity to radiative forcing and the three that programmed in the least sensitivity."

South Africa to bail out failed dictatorship to tune of 10 billion without democratic reforms, amid crackdowns on decent?

Article by Marc Aupiais
One need not repeat the headline, what the SACBC Cardinal Wilfred Napier has asked is that South Africa demand Swaziland reforms before granting the bail out to the mismanaged land!

"Pretoria
24 June 2011
For Immediate release.
Statement by Cardinal Wilfrid Napier, Spokesman of the Southern African Catholic Bishops' Conference (SACBC).
The Catholic Bishops of Southern Africa wish to register their concern at the financial bailout by the South African Treasury of the Government of the Kingdom of Swaziland.
It is understood that an amount of R10 Billion is needed to keep the Swazi Government afloat and the administration from collapsing.

Swaziland is currently in the throes of an unprecedented financial and societal crisis.  It has
• the highest HIV & AIDS infection rate in the world (26%);• the lowest life expectancy in the world (32 years);• an unemployment rate of 40% and rising;• and extreme poverty with 70% of its population living below the poverty line of less than US$6  a day.• A State of emergency that has curtailed freedom of expression, association and dissent for the last 37 years.
We believe that the Swaziland Government must abandon or at least reform the "Tinkhundla" system of governance of royal favour and alliance which is a breeding place for corruption and greed.  Monies intended for alleviating the people's suffering are diverted to support the lavish lifestyle of the monarchy.
The People of Swaziland love their King and Country, but the conditions that have created this crisis must not be disregarded by South Africa in considering a bailout.

We therefore call on the South African Government to make the loan CONDITIONAL on the following:
∙         the recognition and implementation the Universal Declaration of Human Rights in Swaziland;∙         the revocation by King Mswati III of the royal decree of 12 April 1973 which established a state of emergency;∙         that King Mswati III enter into meaningful dialogue with his people in order to facilitate movement  towards true democracy his country;∙         the establishment of a democratic process for writing a new constitution in which all Swazi's have a part;∙         that the current Swazi Constitution be amended to reinstate the full range of human rights;∙         And that none of the bailout money go directly or indirectly to fund the Monarchy.
In the same way that the South African Government has laudable process examining the sale of Arms to other countries, the same type of process should be employed when it comes to financial support for ailing regional economies.

Cardinal Wilfrid Napier
Archbishop of Durban
Spokesman for the Southern African Catholic Bishops' Conference
(The SACBC is constituted by the Catholic Bishops of Botswana, Swaziland and South Africa)

That quoted, South Africa sold arms to Libya, North Korea, just saying etc. I don't think it will be conditional!

Government spokesman accuses the media of being-Cartel like

M E Aupiais

Government spokesman or perhaps ruling party or personal of himself spokesman is the question to be asked of Mnyani. Either way, South African media have huffed and puffed about the comments, worried as government tries to close the noose on media Freedom, already precariously on a cliff face in the Republic.

As for Mnyani, he says the media is like a cartel and refuses to answer on Norwegian corruption allegations.

"I ask myself ... Why is the media so hostile to the government" Myani is quoted by Independent Newspapers' political Bureau as telling Talk Radio 702 host John Robbie.

"They all speak the same, they all think the same" he is reported to have said of the three main media houses, saying media needed to be "diversified", a phrase similar to that of "transformed", by which loyal and incidentally black judges have replaced independent white ones in South Africa's post-apartheid judiciary (South Africa rejects the jury system).

Media in the Republic have claimed new regulations allowing government to prevent publication of articles, stories is tantamount to silencing the press. Media have and have always had no special rights or protections in South Africa, and journalists do get sent to jail for protecting sources, if caught, as with lawyers who have no attorney client privilege.

Manyi said that there were 'shocking' cartel-like tendencies at work in the call by SA National Editor's Forum chairperson Mondi Makhanya asking media to work together in light of the latest regulations suggested. Trade Union and Tripartyd Alliance member Cosatu has slammed the regulations as undemocratically penalising whistle blowers. Their close alliance with the ANC has lead to delays in the regulations' release.

Recently the Regulation of the Interception of Communications Amendment Act mandated that all mobile phone conversations' contents be recorded for the state by mobile (or in South African English: Cellular) Operators. This in addition to smses (texts) which companies already kept for five years after customers made them. Also to be kept for the government: all emails made through or in the Republic.

Added to this, and increased funding for the police now under a Zuma loyalist, and the army, the press claim that media freedom itself is at stake.

In South Africa where the ANC has had a massive majority in parliament since 1996, and the Nationalist party had the same setup before, media has often been the only real opposition voice.

Media in South Africa has been accused of a liberal or white bias, despite most journalists being black. This is not unexpected, and the opposing English (liberal, at times: anti-Apartheid) and Afrikaans (conservative, at times: pro-apartheid) views of the past are both at odds with the more Africanist ANC.

BEE, and transformation laws: mandating massive sale of shares to blacks, and hiring of blacks, and support of charities aiding blacks, not whites: something which has lead ANC allies to have massive unfair business success, have yet to cause media to become an ANC ally.

An attempt at an ANC newspaper failed recently. The SABC, the state run broadcaster has been accused since the days of Thabo Mbeki's presidency of giving cabinet ministers unfair time on television, and radio, and of being a propaganda service. SABC heads who don't toe the party line whether related or not, tend to be called to ANC headquarters.

The majority of South Africans get their views via Government radio, and not the barely penetrating three major independent press houses: Naspers, Independent Media, and SAPA!

My greatest weakness

Note by Marc Evan Aupiais

What's my greatest weakness? Accountability!

I need to be honest, ethical, accountable in all I do: or I feel terrible, get sick, and cannot function.

I don't lie! I'm me! Always! Even if it hurts me!

I don't feel embarrassment! Not easily!

What some would hide I put up into print!

If I were mocked or bullied or hurt for telling truth! And there happened to be a camera recording it! And someone in charge of the mocking in authority! I might just save such video to hold them accountable.

Of course I am also discerning! There are actions I should do, to prevent harm to others that I will not do.

And I would not stop someone betraying or letting me down.

I have a need for accountability and to always be real and moral! And ethical!

What I get I must get the right way or I'll probably destroy or throw it out.

Mother told me a story as a child: of how the Allies when they came across the advanced Nazi medical knowledge, destroyed it: it was gained by murder!

It's guided me through life! Ethics! Not just looking good, being good! And gaining what you gain morally and honestly! Without destroying your own human dignity by sin, greed, unethical, immoral acts.

I was always taught "be international", there's always a "bigger pond", be accountable to the Universe and God.

It is this that stops me hating and enables me forgiveness! Though I struggle!

And accountability! This guides me! My name is who I am! I am Marc Evan Aupiais! I do all in my name!

Yes! It is a sin to reveal sins without just cause! But sometimes its a sin not to! Anything I do! I own up to! I face the music, and the muse!

My honesty is my greatest weakness! But its who I am! And I won't deny it! It is my choice! And thus my greatest strength!

The evil youth

Note by M E Aupiais

Its assumed often that youth are depraved! That teenagers etc naturally are!

This wasn't always the case and in many societies isn't!

Teenagers may be depraved if their parents let their desires, every want, or tv or the shocking "teen" books out these days guide them.

But a fruit is of the tree!

A parent who raises an individual gets one. A parent who teaches things, money isn't everything but has importance next to other true gifts, which matter more: friendship, honesty, integrity, conscience, religion, virtues; godliness, God- gets such a child!

A parent who raises a thinking discerning child gains a thinking discerning child.

I am 20 turning 21! I still won't watch 18 movies or 16 for sex!

I also don't drink or smoke!

I credit much of this to my upbringing!

Born and bred!

I was taught to think! Before any other lesson was learnt!

Drug war- why the idiot governments fail

Note by Marc Aupiais

Politicians being the druggie associates they are, in many countries want to stop the drug war.
They say it fails.

I'll tell you why. When those buying have virtual impunity, supply continues.

If you want to stop drugs, have drug testing like alcohol testing and have long sentences- for users!

Not just small fines and done. No wonder you lose. No. Send drug users to jail, confiscate their cars and houses.
One may say- what it they don't seek help then.

Well perhaps create an amnesty for those who do and complete thirty days cold turkey or the like.

Fact is- the reason drug wars fail and lives are lost and the economies damaged- is that drug use only has the penalties of using.

6 months in a rehabilitation centre mandatory or the like, even when clean. And perhaps some hard labour would have a different effect if enforced and publicised!

Sexualization of minors slated by Great Britain

Note by Marc Aupiais

The Tory Coalition government in Great Britain has slated as detrimental the sexualization of children. Rightly identifying a main source, it has attacked music videos.

Another source seemingly left unidentified- lies in the immoral lives of celebrities children are encouraged to emulate. Especially American actors, actresses, and singers.

Particularly those of the ex-Disney brand- a situation caused by American refusal to ban child labour, despite evidence of lost childhoods, drug addiction, and other problems.

Russian Federation bans European Vegetables imports

Note by Marc Aupiais

The Republic's BRICS ally, the Russian Federation, has banned imports of European vegetables over E.Coli. Blaming Cucumber, the Sprouts, EU authorities have yet to find the deadly source of outbreak. Russia has determined to risk good relations with Europe, seemingly in order to insure Russian lives are not lost in diplomacy.

The Republic exports fruits and vegetables to Europe, and any imports from Europe in South Africa on fruits and vegetables are minimal. Our Russian ally, however, imports vegetables from Europe.

DA doing better

Analysis by Marc Aupiais

I obviously voted DA. No question. Most white South Africans did. Most educated South Africans did. The better service and lack of nepotism is enough to attract voting.

Mother got us all to wake early and vote. I'd been planning a day off... But she insisted, so us four went off to vote.

I'm glad I did.

24 % is good. After Us is IFP with like 2 percent, then COPE, and the IFP offshoot.

24 percent, when whites are a minority. That means black votes. That means a lot of black votes.

I joked I wanted to play a Selena Gomez cd to block out the megaphone shouting ANC lies at campus on Monday already. Sadly many South Africans consider voting a duty not a right. That is to say if they register they feel they have no choice who to elect.

Fear and hatred of whites oft still dominates. We the slain beast. Just as Americans rejoice at the slaying of a certain senile arab.

Fear disrupts democratic truths. We are stopped electing who we want and instead vote against who we despise.

So, I voted DA... Because I'm sick... Tired... Of being ripped off for Electricity, unsafe roads, internet, telephone, cellular phone, tv. I'm sick also of a government which canvasses votes on hatred of my tribe- the white tribe- the "Europeans" who our basically illiterate president says are not consistent with a "true South African".

Speaking of which, #1984 who's next on America's hit list. Yemen?
